By accessing or using BerryMap ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, with changes effective upon posting. Your continued use of the Service after changes constitutes acceptance of the modified terms.
2. Description of Service
BerryMap is a bilingual (English/French) AI-powered hiring platform that connects job seekers with employers. Our comprehensive services include:
- AI-Powered Resume Parsing: Automatic extraction of skills, experience, and qualifications from uploaded resumes with bilingual support.
- Intelligent Match Scoring: Deterministic algorithm calculating compatibility between candidates and positions based on skills, languages, experience, education, salary expectations, and commute preferences.
- AI Career Coach: Personalized career guidance and professional feedback for job seekers, including constructive insights from application outcomes.
- Applicant Tracking System (ATS): Kanban-style pipeline management for hiring managers with status tracking, notes, and bulk actions.
- Geospatial Job Discovery: Interactive map-based job search with location filtering, commute calculations, and clustering.
- Real-Time Messaging: Instant communication between candidates and hiring managers with presence indicators and offline email notifications.
- Interview Scheduling: Calendar integration with Google Calendar and Microsoft Outlook for seamless interview coordination.
- Careers Page Embedding: Customizable branded job boards that companies can embed on their websites.
- Tiered Subscriptions: Free, Pro, and Enterprise plans with varying feature access for companies.
3. User Accounts & Roles
BerryMap supports two primary user roles:
- Job Seekers: Individuals searching for employment opportunities who can create profiles, upload resumes, apply to positions, and communicate with employers.
- Company Managers: Hiring professionals who manage job postings, review applications, and communicate with candidates on behalf of their organizations.
Account requirements:
- You must be at least 18 years old to use this Service.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information during registration.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
- Users may switch between roles using our universal role switcher feature.
4. User Conduct
You agree not to:
- Post false, misleading, or fraudulent job listings or applications
- Harass, abuse, or discriminate against other users
- Upload malicious content or attempt to compromise system security
- Use the Service for any unlawful purpose
- Scrape, harvest, or collect user data without authorization
- Impersonate another person or entity
- Interfere with or disrupt the Service or servers
- Abuse the AI features or attempt to manipulate match scores
- Create multiple accounts for the purpose of circumventing subscription limits
5. AI-Powered Features
Our Service uses Google Gemini AI to power various features. By using these features, you acknowledge that:
- AI-generated content is provided as-is and may contain errors or inaccuracies
- You are responsible for reviewing and correcting AI-extracted information
- Match scores are algorithmic recommendations based on weighted criteria, not guarantees of suitability
- AI processing is subject to our Privacy Policy
- AI features may be rate-limited based on your subscription tier
AI Features by Subscription Tier:
- Free: Basic resume parsing and match scoring
- Pro: AI Career Coach, AI Interview Question generation, AI Job Template generation
- Enterprise: AI Priority Queue, AI Insights Panel, advanced analytics
6. Match Scoring Algorithm
BerryMap uses a deterministic weighted algorithm to calculate match scores between candidates and positions:
- Skills Matching: Comparison of candidate skills against job requirements
- Language Requirements: Assessment of required language proficiencies
- Experience Level: Years of experience relative to job expectations
- Education: Educational qualifications matching
- Salary Alignment: Comparison of salary expectations with offered compensation
- Commute Feasibility: Travel time calculations based on candidate preferences (when location data is provided)
- Industry Experience: Bonus scoring for relevant industry background
Match scores may be recalculated when candidate profiles or job requirements are updated. Scores may be cached for performance.
7. Content Ownership
Your Content: You retain ownership of content you submit (resumes, job postings, messages, company profiles). By submitting content, you grant us a non-exclusive, worldwide license to use, display, and process it for providing the Service.
Bilingual Content: When you provide content in one language, we may use AI translation services to create versions in the other supported language. You are responsible for reviewing translated content for accuracy.
Our Content: The Service, including its design, features, AI models, and match scoring algorithms, is owned by BerryMap and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary technology.
8. Messaging & Communications
Messages sent through the platform are stored to facilitate hiring communications. Features include:
- Real-time messaging with online presence indicators
- Email notifications for offline messages
- Message archival when applications are completed or withdrawn
You agree not to send spam, harassment, or illegal content through our messaging system. We reserve the right to monitor and remove content that violates these terms.
9. Subscription Plans & Payments
BerryMap offers tiered subscription plans for companies:
- Free Tier: Basic job posting and candidate management features
- Pro Tier: Advanced AI features, priority support, and enhanced analytics
- Enterprise Tier: Full feature access, dedicated support, and custom integrations
Payment terms:
- Premium features require a paid subscription processed through Stripe.
- Subscriptions auto-renew unless cancelled before the renewal date.
- Refunds are provided in accordance with our refund policy and applicable law.
- We reserve the right to modify pricing with 30 days notice to subscribers.
- Non-payment may result in suspension or termination of premium features.
- Downgrading plans may result in loss of access to certain features and data.
10. Candidate Unlock System
To protect candidate privacy, certain profile information is initially hidden from employers:
- Employers may view limited candidate information before unlocking
- Unlocking a candidate provides access to their full profile, including contact information
- Once unlocked, access to a candidate's profile remains available to the company
- Unlock credits may be included with subscription plans or available for purchase
- Candidates may be notified when their profile is unlocked
11. Geospatial Features
Our location-based features include:
- Interactive job discovery map with clustering
- Commute time calculations for driving, cycling, and walking
- Location-based job filtering and recommendations
- Address geocoding for accurate positioning
These features are powered by Mapbox and require location data to function. You may choose not to provide location data, but this will limit the functionality of location-based features.
12. Calendar Integration
BerryMap integrates with external calendar services for interview scheduling:
- Google Calendar and Microsoft Outlook integration available
- Automatic event creation and updates
- Calendar availability checking for scheduling
- ICS file generation for calendar applications
By connecting your calendar, you authorize BerryMap to read your availability and create/modify interview events. You may disconnect your calendar at any time through account settings.
13. Careers Page Embedding
Companies may embed their BerryMap job listings on external websites:
- Customizable branding including colors, typography, and styling
- Embed code provided for easy integration
- SEO optimization for better search visibility
- Direct application functionality with ghost application support
Embedded careers pages must comply with these Terms of Service and may not be modified in ways that misrepresent BerryMap or its services.
14. Email Notifications
BerryMap sends various email notifications based on your preferences and subscription tier:
- Immediate Alerts: New applications, messages, interview requests
- Digest Emails: Daily or weekly summaries of activity
- System Notifications: Account security, subscription changes, platform updates
You may customize your notification preferences in account settings. Some system notifications cannot be disabled for security and legal reasons.
15. Application Withdrawal
Job seekers may withdraw their applications at any time. Upon withdrawal, the associated conversation will be archived and the employer will be notified that the candidate is no longer available. Withdrawn applications cannot be reinstated, but you may submit a new application if the position remains open.
16. Open Applications
BerryMap supports open applications, allowing candidates to express interest in companies, locations, or positions that may not have current openings. Companies may review these expressions of interest and reach out when relevant positions become available.
17. Termination
We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings. Data retention upon account deletion is governed by our Privacy Policy.
18. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE EMPLOYMENT OUTCOMES, THE ACCURACY OF AI-GENERATED CONTENT, OR THE ACCURACY OF MATCH SCORES. AI TRANSLATIONS ARE PROVIDED FOR CONVENIENCE AND MAY NOT BE PERFECTLY ACCURATE.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BERRYMAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.
20. Indemnification
You agree to indemnify and hold harmless BerryMap and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.
21. Governing Law
These terms shall be governed by the laws of Canada, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
